1. Data Ownership and Your Content

You retain all ownership, right, title, and interest in and to the data, information, media, and other content that you upload, input, or generate within the Service ("Your Content"). We do not claim any ownership rights over Your Content. You hereby grant InspectMind a limited, non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and process Your Content solely for the purposes of providing, maintaining, and improving the Service, offering technical support, and ensuring the operational functionality of our application.

2. Privacy and Data Handling

Our commitment to protecting your privacy is detailed in our Privacy Policy. The key principles of our data handling practices are as follows:

Data Collection

We collect personal information, such as names, email addresses, phone numbers, and company details, as well as the media content you provide for your projects and reports. All data is collected exclusively through your direct input into the Service.

Data Use and Intellectual Property

Your Content is used exclusively for your benefit and is protected as follows:

• Service Provision: Your Content is used solely to provide, maintain, and improve the Service for your specific instance and is never sold to any third party.
• Data Segregation: Our platform is architected with strict, programmatic controls to prevent any data crossover between customers, ensuring your information remains separate and confidential.
• AI and Model Training: We do not use your data to train public AI models. We may use your documents to improve our document-processing models (e.g. to better read drawings and find relevant content); this does not use your content in a way that could identify you, and you may opt out at [email protected]. We never share your documents with other customers.

3. Security

We have implemented and maintain robust administrative, physical, and technical security measures designed to protect Your Content and personal information.

Authentication and Access Control

• Primary Authentication: The Service utilizes Firebase for email/password authentication and requires token validation for every data request.
• Multi-Factor Authentication (MFA): We support Time-based One-Time Password (TOTP) applications, including DUO and Google Authenticator.
• Single Sign-On (SSO): SSO capabilities are available for integration.

4. Use of Large Language Models (LLMs)

To provide certain features within the Service, InspectMind AI Inc. utilizes Large Language Model (LLM) services from third-party providers, which include OpenAI, Anthropic, and Google (each, a "Sub-processor"). Your use of features that leverage these LLM services is subject to your acceptance of the terms herein.

We have entered into agreements with our LLM Sub-processors that govern the treatment of Your Content. These Sub-processors are prohibited from using any of Your Content—including text, audio, images, videos, or documents—to train their proprietary artificial intelligence models or to improve their products and services.

5. Nature of Service – AI Assistant Tool

THE SERVICE IS AN AI-POWERED ASSISTANT TOOL DESIGNED TO HELP IDENTIFY POTENTIAL ISSUES IN CONSTRUCTION DOCUMENTS. IT IS NOT A REPLACEMENT FOR HUMAN PROFESSIONAL REVIEW.

You acknowledge and agree that:

• AI Limitations: The Service uses artificial intelligence technology that, while designed to be helpful, is not perfect and will not catch every issue, error, conflict, or code violation in your documents. AI technology has inherent limitations and may produce incomplete results, miss issues, or occasionally flag items that are not actual problems.
• Supplementary Tool: The Service is intended to supplement—not replace—your own professional review processes, quality assurance procedures, and due diligence. It is one tool among many that should be used in a comprehensive document review workflow.
• Human Oversight Required: All findings, suggestions, and outputs from the Service should be independently verified by qualified professionals before being relied upon for any purpose.
• Not Exhaustive: A review by our Service does not constitute a complete, exhaustive, or certified review of your documents. Issues may exist that are not identified by the Service.

6. Not Licensed Professional Services

INSPECTMIND AI INC. IS A TECHNOLOGY COMPANY, NOT A LICENSED ARCHITECTURE, ENGINEERING, OR CONSTRUCTION FIRM.

You acknowledge and agree that:

• No Professional Licensure: InspectMind AI Inc. does not hold any professional licenses for architecture, engineering, construction, plan review, code compliance, or any related professional services. We are not licensed architects, engineers, contractors, or building officials.
• Software Service Only: We provide AI-powered software tools, not licensed professional services. The Service does not constitute professional engineering, architectural, or construction advice.
• Not a Substitute for Licensed Professionals: The Service is not a substitute for review by licensed architects, engineers, contractors, or other qualified professionals. You remain solely responsible for engaging appropriately licensed professionals for your projects.
• Not a Substitute for Official Plan Review: The Service is not a substitute for, and does not replace, official plan review by building departments, code officials, or other governmental authorities. You remain solely responsible for obtaining all required permits, approvals, and official reviews.
• No Stamps or Certifications: InspectMind does not provide professional stamps, seals, certifications, or any form of professional endorsement of construction documents.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, InspectMind disclaims all warranties, express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any warranty that the Service will identify all issues, errors, conflicts, or code violations in your documents
• Any warranty that the Service's outputs will be accurate, complete, reliable, or error-free
• Any warranty that the Service will meet your specific requirements or expectations
• Any warranty regarding the results or outcomes of using the Service

You expressly acknowledge that AI technology has inherent limitations and that no AI system can guarantee detection of all potential issues in construction documents.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INSPECTMIND AI INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Any issues, defects, errors, conflicts, or code violations in your documents that the Service fails to identify or flag
• Any issues incorrectly identified or flagged by the Service (false positives)
• Any decisions made or actions taken based on the Service's outputs
• Any construction defects, delays, cost overruns, or project failures
• Any personal injury, property damage, or other harm arising from construction activities
• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or business opportunities

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You acknowledge that the fees charged for the Service reflect this allocation of risk and that InspectMind would not provide the Service without these limitations.

9. Indemnification

You agree to indemnify, defend, and hold harmless InspectMind AI Inc. and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service
• Your construction documents and projects
• Any reliance on the Service's outputs without independent professional verification
• Your violation of these Terms
• Your violation of any applicable laws, regulations, or third-party rights

10. User Responsibilities

By using the Service, you represent and warrant that:

• You will engage appropriately licensed professionals (architects, engineers, contractors, etc.) for your construction projects
• You will obtain all required permits, approvals, and official plan reviews from appropriate governmental authorities
• You will independently verify all findings and outputs from the Service before relying on them
• You will not rely solely on the Service for code compliance, safety, or quality assurance
• You understand and accept the limitations of AI technology as described in these Terms
• You have the authority to upload and submit the documents you provide to the Service
